Benarkah DPD RI Tidak Berdaya?

DPD atau Dewan Perwakilan Daerah merupakan lembaga baru melengkapi struktur kedaulatan rakyat sebagaimana dimaksud oleh UUD 1945.  Semangat pembentukan lembaga kedaulatan rakyat baru ini dimaksudkan sebagai kekuatan penyeimbang DPR yang sudah terlebih dahulu ada dalam sistem ketatanegaraan Indonesia.  Di luar negeri,khususnya di Amerika, DPD lebih dikenal sebagai Senat.  Anggota Senat Amerika disebut dengan Senator.  Meski secara institusi dapat dipersamakan dengan Senat di Amerika Serikat, namun DPD berbeda.  Terutama dari segi kewenangan.

DPD RI ditegakkan pada tiga fungsi utama yaitu legislasi, pengawasan dan pertimbangan.  Meskipun memiliki fungsi legislasi, namun jangan salah fungsi ini tidaklah sekuat sebagaimana gambaran orang.  Dari sisi objek, fungsi legislasi yang dimiliki DPD terbatas untuk RUU yang terkait dengan kebijakan daerah seperti RUU yang berkaitan dengan otonomi daerah; hubungan pusat dan daerah; pembentukan, pemekaran, dan penggabungan daerah; pengelolaan sumber daya alam dan sumber daya ekonomi lainnya, serta perimbangan keuangan pusat dan daerah. Sedang dari sisi kekuatan legal, fungsi legislasi yang dimiliki DPD RI hanyalah terbatas pada pengajuan usul, pembahasan dan pemberian pertimbangan, tidak sampai pada pengambilan keputusan.

Itulah mengapa suara DPD RI hampir tak terdengar di tengah hiruk pikuk perpolitikan tanah air. Dapat dikatakan jiwa reformasi yang hendak diusung dengan menjadikan DPD RI sebagai kekuatan penyeimbang DPR tidak tercapai.  Perlu upaya yang serius bagi negara untuk menjadikan DPD RI lebih berdaya dengan memberikan kewenangan yang lebih besar kepada DPD.

KOntes SEO Disabilitas dan Pandangan Masyarakat


KOntes SEO untuk mempopulerkan penggunaan istilah disabilitas sebagai pengganti 'penyandang cacat' akan segera berakhir. Sampai sejauh ini kontes yang diikuti oleh para master SEO mulai menunjukan dinamikanya. Saling berkejar-kejaran pada posisi top one page google sudah menjadi cerita keseharian. Postingan blog ini yang mencoba secara hati-hati memahamkan tentang disabilitas secara sukses telah berada pada halaman antah berantah belantara google. Alasannya sederhana saja: maklum masih newbie neh.
Meskipun begitu tak ada kata menyerah. Meski belum terindeks google setidaknya suatu saat nanti ada peselancar yang membaca postingan saya tentang disabilitas dan pandangan masyarakat akan mendapatkan manfaatnya.

    Disabilitas dan pandangan masyarakat

    Merunut satu-persatu postingan lowongan kerja yang pernah dilansir blog ini, tibalah pada satu kesimpulan yang selama ini tak pernah terpikirkan. Ya, semua lowongan pekerjaan tersebut hanya diperuntukkan bagi orang normal. Bagaimana dengan mereka yang masuk kategori penyandang disabilitas? Bukankah para penyandang disabilitas itu juga berhak mendapatkan kesempatan yang sama dalam berusaha dan berkarya? Disabilitas dan pandangan masyarakat saat ini telah menjadi tema diskusi yang mulai fokus pada pemberdayaan kaum penyandang disabilitas. Meskipun mereka, para penyandang disabilitas tak banyak menuntut mengenai fasilitas publik yang khusus diperuntukkan bagi penyandang disabilitas, namun beberapa aktivis persamaan hak disabilitas mulai menggugat kewajiban pemerintah untuk menyediakan layanan publik khususnya bagi penyandang disabilitas.

    Disabilitas dan pandangan masyarakat
    Bukan merupakan hal yang aneh bila di sebagian besar masyarakat masih melihat sebelah mata para penyandang disabilitas. Mulai dari ketidak percayaan akan kemampuan penyandang disabilitas menghidupi dirinya sendiri hingga pelecehan yang fokus pada kekurangan fisik yang disandang penyandang disabilitas. Meski sebagian besar penyandang disabilitas membuktikan bahwa dirinya mampu berprestasi sebagaimana orang normal fisik, namun kondisi umum penyandang disabilitas sering disalahgunakan oleh oknum kaum disabilitas itu sendiri maupun orang normal. Tayangan investigasi televisi swasta beberapa kali melaporkan reportasenya bagaimana penyandang disabilitas ini memanfaatkan kelemahan fisiknya untuk memancing iba masyarakat dengan menjadi peminta-minta. Dan bukan cuma kaum disabilitas saja, masyarakat yang normal pun banyak berimprovisasi menyembunyikan kenormalannya dan berakting seolah-olah mereka adalah kaum disabilitas dengan berpura-pura kehilangan kaki, luka yang borokan dan berbagai kondisi disabilitas lainnya. Profesi meminta-minta pada umumnya identik dengan kaum disabilitas. Suatu bentuk pelecehan terhadap penyandang disabilitas yang harus segera dituntaskan.

    Pengertian Disabilitas
    Sebagian besar masyarakat belum begitu familiar dengan istilah disabilitas. Bagi mereka yang terpelajar memang akan dengan mudah mengartikan disabilitas sebagai suatu bentuk ketidakmampuan. Dis berarti tidak, Abiliti berarti kemampuan. Disabilitas memang merupakan kata bahasa Indonesia yang diserap dari bahasa Inggris Disability. Sampai di sini pengertian disabilitas nampaknya memang tidak salah. Namun ketidakmampuan yang melekat pada pengertian disabilitas tersebut adalah pengertian umum. Tidak secara khusus dilekatkan pada penyandang cacat atau kekurangan fisik tubuh manusia.

    Disabilitas itu sendiri sekarang mulai gencar dipublikasikan sebagai pengganti frasa 'penyandang cacat'. Penggantian ini dibangun berdasarkan kesadaran bahwa selama ini istilah penyandang cacat justru menjadi alat yang memojokkan penderitanya ke dalam sudut stigma bahwa mereka memang pantas untuk dikasihani, tidak bermartabat, malas dan senang mengambil simpati orang untuk keuntungan pribadi. Kesimpulan ini muncul dari fakta bahwa modus berpura-pura menjadi penyandang cacat adalah modus paling popular di kalangan pengemis kalau ingin sukses dalam karir minta-meminta.

    Pandangan Masyarakat terhadap Istilah Disabilitas
    Meskipun memberikan wacana baru di ruang publik, belakangan istilah disabilitas sendiri mulai digugat karena justru merendahkan martabat penyandang cacat. Penggugatnya sendiri adalah sorang tunanetra. Tak tanggung-tanggung, Ketua Tunanetra Indonesia. Rasionalisasinya adalah disabilitas adalah kehilangan kemampuan untuk bertindak sebagaimana orang normal lakukan. Padahal penyandang cacat bisa melakukan sesuatu yang melebihi kemampuan yang orang normal lakukan. Perbedaannya hanya terletak pada cara melakukan. Programmer normal melakukan aktivitasnya dengan mengetik kode program secara langsung di depan layar. Penyandang cacat pun dapat menjadi progammer komputer, hanya dilakukan dengan bantuan software khusus. Alasan inilah yang mendasari kenapa istilah disabilitas ditolak.

    Meski masih berada dalam ranah kontroversi, istilah disabilitas sebagai pengganti penyandang cacat bagai bola salju, menggelinding ke bawah makin membesar. Adalah kartunet.com yang dengan gencar mensosialisasikan penggunaan disabilitas ini. Apabila kita masuk dan berselancar pada situs kartunet.com , seolah tak percaya kalau situs yang tampilan dan isinya profesional ini sepenuhnya dikelola oleh mereka orang-orang yang mengalami keterbatasan penglihatan. Disabilitas yang mereka sandang, tak menghalangi langkah mereka untuk mendistribusikan pengetahuan via internet dengan menyediakan tutorial online dan e-book agar para penyandang disabilitas terbukakan wawasan dan pengetahuan mereka. Meleknya para penyandang disabilitas ini terhadap teknologi informasi pada akhirnya diharapkan mejadi pengungkit bagi semangat dan produktivitas penyandang disabilitas lainnya.
